Okay, that Bayo thing created quite a stir among Pinoy bloggers. People are posting the messages in their blogs, boycotting Bayo products and dropping words of encouragement and support at Emma’s BBS.
However, I found this message from Emma over at her BBS:
“My dear Filipino friends and fellow artists
++ EMMAI am truly impressed and feel happy for receiving many messages
of encouragement over this BAYO incident.I have been consulting this matter to various institutions
including the Japan Embassy to the Philippines and
Philippine branch of the Japan’s Patent Office.
They advised me that this is a very sensitive case involved with
the intellectual property rights law.In line with this, they cautioned me that it may be possible
that your efforts such as boycotting the BAYO products
and voicing out your concerns against BAYO would rather cause
me legal disadvantages if this case will be brought to the court
in terms of damaging the public image of BAYO.
I therefore appreciate if you could stop making such public comments.I also heard that there are many people directly complaining
against BAYO by e-mails or telephone calls, saying they do so
on behalf of me. Unfortunately, I have to ask you to stop these
actions, too, due to the same reason.I am very sad to learn the reality that your kind, brave and
sincere actions have a risk to result in the opposite direction.
I can’t tell you how disappointed I am that I am no longer able to
accept your aid under these circumstances. I am so sorry.I may also have to delete the related messages on my website soon.
I am going to let you know the results of this matter when everything is settled.Again, thanks a lot for your support!

It’s confirmed: Emma was the one who wrote that message in her board. Let’s respect her wishes.

err, i’m the one who left that comment on emma.mori’s BBS. i was a fan of hers before and was surprised when bayo kids made shirts with her art on them. didn’t mean to raise a ruckus. i thought they asked her already. they’re an established company, aren’t they? isn’t it professional, at the very least, to get permission?
i didn’t mean to whine. haha. it was kind of a wake-up call seeing my words somewhere else on the web so early in the morning and my befuddled mind can’t comprehend the full implications of all this. need to finish my 2nd cup of coffee. :D

I took a peek in here: http://www.lovebayo.com/. I checked out their t-shirt designs and saw one of them still had EMMATIC’s art.

you did right to ask emma whether Bayo asked her permission to use her designs, in my opinion. as a business, they should know about the legalities of using other people’s design. tsk tsk.

Lol. Anna, remember where we live. It’s practically a common occurence for someone to so casually lift something off and claim it as their own.
Someone should warn Bayo to smarten up before they get slapped with a lawsuit and end up losing face. Tsk.

Boycoting BAYO is not the answere, remember that 100% of thier employees are Filipino. Let’s face the fact that MOST of our local clothing brand (” “)copied a concept and designed up to the very small detailing and finishing. To all local merchandisers and designers pls correct me if im wrong. Lets be practical….
^ practical eh? still inde parin pede na meron na news of piracy ay inde parin tinatangal ng bayo yung product line na yun. although wala na sa website nila, tumingin ako kahapon sa bayo at andun pren yung “bambi” line nay yun. sa bayokids naman, andun pren yung wide eye kids.
if bayo really didn’t mean to steal the design, dapat tinangal na nila yung mga stolen designs. im sure nakarating na sa kanila yung news na yun. my friend from another clothing company knows about it (industry nila eh, so dapat talaga alam nila). so most likely, bayo knows about it to.
too bad they are not doing anything about it.
i think its unfair to falsely accuse bayo of copying in this site where they cannot answer each and every one. I suggest that if there is indeed a violation of copyright, proper cases shall be filed against them so that we would know if indeed there was such violation. by the way, is bambi copied from disney?

That’s the root of the problem — Bayo has, afaik, refused correspondence with Emma. That in itself is suspicious, don’t you think?

Bambi is by Disney, but I think it was Emma’s design (looks like Bambi, but different) that Bayo lifted.
J Valmadrid makes a good point about the employees of Bayo being Filipino and our need to support our industry. But this doesn’t mean that we have to condone blatant copying of designs. It not only insults the designer, it implies that we have no talent and have to resort to lifting designs.

Thanks AMANDA, i hope that our talented designers and merchandisers do design and concept of their own. In Garment business there are two things a merchandiser (w/ the designer) must look into : the business side and the product side, we must create a concept and the design that WILL sell.
SELL? or the one that will be patronized by our local customer… and what is that concept or design? That is the one “NA MAY DATING AT ITSURANG IMPORTED”, remember in our high school and college history subject???? when we heard filipino history ang laging kasunod nun ay yung “COLONIAL MENTALITY”. Merchandisers and designers work together to create yung mala imported na produkto. We produce a concept and product that will sell, and not the one na may originality nga pero di naman bebenta, yan ang meaning ko ng “PRACTICAL”… GERMS
Thanks for posting the message from Emma. It’s genuine, from herself. I’m Lisa, a Japanese based in Manila and got to know Emma through this incident. We’ve been in touch and she asked me to translate that message from Japanese. I’ve also got mails from BAYO saying that they take this matter seriously and hope to communicate with Emma through Japan Embassy. Let’s see.
